These Terms & Conditions apply to purchases made through the Australian Arvine online store operated by Daily Moment (Australia) Pty Ltd (“Arvine”, “we”, “us” or “our”).

By accessing our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

In these Terms & Conditions:

• “you” and “your” refer to the person placing an order through our website;

• “Website” means arvine.co and the Australian online store accessed through it; and

• “Products” means products offered for sale by Arvine through the Australian online store.

These Terms & Conditions apply to orders placed for delivery within Australia.

1. Orders

When you place an order through our Website, you are making an offer to purchase the selected Products subject to these Terms & Conditions.

After your order is submitted, you will receive an order confirmation using the contact details provided at checkout. Receipt of an order confirmation does not necessarily mean that your order has been accepted or dispatched.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

• a Product is unavailable;

• there is an error in the price or Product information;

• payment cannot be authorised;

• we reasonably suspect fraudulent or unauthorised activity; or

• we are unable to fulfil the order.

If payment has already been received for an order that we cannot fulfil, we will provide a refund for the affected Product or order.

Products purchased through our consumer Website are intended for personal use or gifting. Commercial resale or distribution of Arvine Products without our prior written approval is not permitted.

2. Product Information

We take reasonable care to ensure that Product descriptions, photographs, ingredients, sizes, prices and other information displayed on our Website are accurate.

However, colours, packaging and appearance may vary slightly from images displayed online due to factors including screen settings, photography, packaging updates and manufacturing variations.

From time to time, we may update Product packaging, formulations or other Product information.

Where ingredient information is important to you, including in relation to allergies or sensitivities, please review the Product packaging before use and contact us if you require further information.

3. Prices

Unless otherwise stated, all prices displayed on the Australian Arvine online store are:

• in Australian Dollars (AUD); and

• inclusive of Goods and Services Tax (GST), where applicable.

Prices may change from time to time without prior notice.

The price applicable to your order will be the price displayed at the time your order is submitted, subject to correction of any obvious pricing or technical error.

Any applicable delivery charges will be displayed before you complete your purchase.

4. Payment

Payment must be made using one of the payment methods available at checkout.

Available payment methods may change from time to time.

Your order will not be dispatched until the required payment has been successfully processed or otherwise confirmed.

You are responsible for ensuring that the information provided during checkout is accurate and that you are authorised to use the selected payment method.

5. Shipping & Delivery

We currently deliver Australian orders to eligible addresses within Australia.

Available shipping methods, estimated delivery timeframes and applicable shipping charges will be displayed on our Website or during checkout.

Delivery timeframes are estimates only and may vary depending on your location, carrier delays, public holidays, weather events or other circumstances outside our reasonable control.

Please ensure that your delivery address is complete and accurate before submitting your order.

Once an order has been processed or dispatched, we may not be able to change the delivery address.

If a parcel is returned to us because an incorrect or incomplete address was provided, additional delivery charges may apply before the order can be resent.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

6. Order Changes & Cancellations

If you would like to change or cancel an order, please contact us as soon as possible at admin@arvine.co.

We will make reasonable efforts to assist you. However, once an order has been processed or dispatched, we may not be able to amend or cancel it.

If we are able to cancel an order before dispatch, any applicable refund will be returned to the original payment method.

7. Returns & Refunds

Returns, exchanges and refunds are subject to our Return & Refund Policy and your rights under the Australian Consumer Law.

Nothing in our Return & Refund Policy or these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Where a Product is faulty, damaged, unsafe, incorrectly described or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a remedy under Australian law.

For hygiene and safety reasons, we may not accept change-of-mind returns for Products that have been opened, used or had their protective packaging or seals removed, except where required by law.

8. Australian Consumer Law

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify your rights under the Australian Consumer Law.

9. Product Use

Arvine Products must be used in accordance with the instructions provided on the Product, packaging or Website.

Our cosmetic Products are intended for external use only unless expressly stated otherwise.

You should discontinue use if irritation or an adverse reaction occurs.

Product information provided through our Website is general in nature and is not intended to constitute medical or healthcare advice.

To the extent permitted by law, Arvine is not responsible for loss arising from misuse of a Product, use contrary to Product instructions, or use for a purpose for which the Product was not intended.

Nothing in this section limits liability that cannot lawfully be excluded or limited.

10. Promotions & Discount Codes

From time to time, Arvine may offer promotions, gifts with purchase, promotional codes or other special offers.

Unless otherwise stated:

• promotions are available for a limited time or while stocks last;

• promotional codes cannot be exchanged for cash;

• only one promotional code may be used per order;

• promotional offers cannot be applied retrospectively to previous purchases; and

• additional terms may apply to individual promotions.

Where specific promotional terms conflict with these Terms & Conditions, the specific promotional terms will apply to that promotion.

We reserve the right to modify, suspend or withdraw a promotion where reasonably necessary, subject to applicable law.

11. Availability

All Products are subject to availability.

We make reasonable efforts to keep inventory information accurate. However, occasionally a Product may become unavailable after an order has been placed.

If we are unable to supply a Product you have ordered, we will contact you and provide an appropriate refund or other available option.

12. Risk & Ownership

Risk in the Products passes to you when the Products are delivered to the delivery address specified in your order.

Ownership of the Products passes to you once we have received full payment for the Products and they have been delivered.

13. Website Information

We aim to keep our Website accurate, secure and available. However, we do not guarantee that access to the Website will always be uninterrupted or error-free.

The Website may occasionally be unavailable due to maintenance, technical issues or circumstances outside our reasonable control.

To the extent permitted by law, we may update, modify or remove Website content at any time.

All content appearing on the Arvine Website, including the Arvine name and branding, logos, Product names, photographs, graphics, packaging designs, written content and other materials, is owned by or licensed to Arvine unless otherwise stated.

You must not reproduce, distribute, modify, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Arvine will not be liable for loss or damage arising from circumstances outside our reasonable control or from misuse of our Products.

Any limitation or exclusion of liability contained in these Terms & Conditions applies only to the extent permitted by law.

16. Events Outside Our Control

We will not be responsible for delays or failure to perform our obligations where this results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, transport or postal disruptions, industrial action, government restrictions, supply-chain interruptions, telecommunications failures or other similar events.

Where possible, we will take reasonable steps to minimise the impact of such events.

17. Privacy

Personal information collected through the Website will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

18. Governing Law

These Terms & Conditions and purchases made through the Australian Arvine online store are governed by the laws applicable in Queensland, Australia.

You and Arvine submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.

Nothing in this section limits any rights you may have under applicable Australian consumer law.

The Terms & Conditions applying to an order are those published on our Website at the time the order is placed.
